الملخص
This study aims to find an alternative concept, according to Muhammad Abed al-Jabiri, of the prohibition of alcohol which many scholars have considered the result of istinbat nasikh-mansukh. As a methodical step, this research uses a qualitative-descriptive method, with library research data collection techniques and content analysis (content analysis). This research is essential because before alcohol is judged to be haram, it goes through legal processes and stages until it is finally condemned to be haram. The legal stages of khamr have historically been legalized by a legal text which is none other than the Qur'an; Q.S. Al-Nahl (16): 67, Q.S. Al-Baqarah (2): 219, Q.S. Al-Nisa '(4): 43, and Q.S. Al-Maidah (5): 90. The above verse forbidding alcohol by many scholars is categorized as a process of nasikh-mansukh. However, is it true that the process of prohibiting alcohol is the result of the nasikh-mansukh process? This research focuses on the formulation above, which produces a (temporary) conclusion that, according to Muhammad Abed al-Jabiri, prohibiting alcohol is not through the nasikh-mansukh process because it is not appropriate if it is not appropriate there are verses of the Qur’an that experience revision and cancellation. The process of prohibiting alcohol is a process of tadarruj (gradual) which implies that all verses of alcohol still have an object (khitab) to the conditions of the developing times. The verses for the law of alcohol before the verses that forbid it are now called the al-mansa verse. At certain times and under certain circumstances, a Muslim may drink alcohol, such as for a person who has just converted to Islam, so that he cannot leave his drunken habit at once.
